1. Purpose of the Service
BallSimulator.com is a SaaS platform allowing for the generation of original physical simulations for content creation (TikTok, YouTube Shorts, etc.). Use of the Service implies full and unreserved acceptance of these terms.
2. Eligibility
The Service is strictly reserved for individuals aged 18 years and older. By registering, you warrant that you comply with this condition.
3. Offers and Billing
BallSimulator offers two types of paid access:
- Gamer Pack: A one-time payment granting specific access to features for a fixed duration of one (1) year from the date of purchase. This access is not a subscription and does not renew automatically. Access expires at the end of the 12-month term, unless a new pack is purchased.
- Creator Pro: Monthly subscription access. The subscription is non-binding and automatically renews each month on the anniversary date.
The customer can view current rates at any time on the Site’s pricing page. For the Creator Pro offer, you may cancel the renewal at any time via your dashboard; access remains valid until the end of the paid period.
4. Intellectual Property & License
BallSimulator holds all rights to the simulation algorithms. Any reverse engineering or reproduction of logical functions for competitive purposes is strictly prohibited under penalty of legal action. By subscribing to a paid offer (Gamer Pack or Creator Pro), you benefit from a non-exclusive commercial license to publish and monetize the generated videos. Reselling or redistributing raw files without original creation is strictly prohibited.
5. Duty of Loyalty
Users and partners commit to a loyal use of the Service. The development or promotion of a direct competing tool during the period of use or partnership constitutes a serious breach of these terms and may lead to legal proceedings.
6. Audio & Copyright
BallSimulator may provide a library of sound effects (SFX) and music. While we strive to offer royalty-free content, the user is solely responsible for the audio tracks they choose to use. BallSimulator shall not be held liable for claims, « strikes, » or demonetization on third-party platforms (YouTube, TikTok, Instagram, etc.). We recommend using the official audio libraries of social networks for final publication.
7. Refunds & Withdrawal
Due to the digital nature of the Service and immediate access to content upon payment, no refunds are granted for either the Gamer Pack or the Creator Pro subscription. By confirming your purchase, you expressly waive your right of withdrawal in accordance with legal provisions regarding digital content.
8. Liability
BallSimulator provides a technical tool and cannot be held responsible for decisions made by third-party platforms (TikTok, YouTube, etc.) regarding monetization, reach, or removal of your content. We do not guarantee uninterrupted availability of the service in case of maintenance or technical constraints.
10. Suspension and Termination for Breach
In the event of a serious breach of these terms, particularly regarding Articles 4 (Intellectual Property) and 5 (Loyalty), BallSimulator reserves the right to immediately suspend or terminate the user’s account access, without notice and without any refund of fees already paid, without prejudice to any damages that may be claimed.
